Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Tapeout (“we”, “us”), governing your use of the Tapeout plugin, website, hosted services, and MCP server (together, the “Service”). By installing, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service
Tapeout is an AI-assisted design copilot for KiCad. It helps you draft, place, route, and check printed circuit boards through a chat interface, a plugin, and an optional MCP server. The Service uses large language models and automated engines whose output is probabilistic and may be incomplete or incorrect.
2. Not a substitute for engineering review
You are solely responsible for reviewing, verifying, and validating every design, suggestion, and file produced with the Service before manufacturing, ordering, or otherwise relying on it. Tapeout does not guarantee that any output is correct, complete, manufacturable, safe, or fit for any purpose. Never send a board to fabrication without your own review.
3. Accounts
You sign in with a third-party identity provider (for example GitHub or Google). You are responsible for activity under your account and for keeping your credentials and API keys secure. You must be at least 16 years old, or the age of digital consent in your country, to use the Service.
4. Plans, billing, and taxes
The Service offers a free tier and paid subscription plans. Paid plans are sold and processed by our reseller and merchant of record, Lemon Squeezy (Lemon Squeezy, LLC), which handles payment, invoicing, and applicable taxes. Subscriptions renew automatically until cancelled. Prices may change on notice for future billing periods. Refunds and cancellations are governed by our Refund & Cancellation Policy.
5. Bring your own key (BYOK)
Paid plans may let you connect your own API keys from third-party model providers (for example OpenAI, Anthropic, or Google). When you do, requests may be billed directly to your provider account, and your use of those providers is governed by their terms. You are responsible for your provider accounts, their costs, and their usage limits. Your provider key is stored on your own machine; we do not retain it on our servers beyond forwarding a single request on your behalf.
6. Acceptable use
You agree not to: (a) use the Service unlawfully or to infringe others’ rights; (b) attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure; (c) resell or redistribute the Service without our permission; or (d) use the Service to produce unlawful or harmful content. We may suspend or terminate accounts that breach this section.
7. Your content and intellectual property
You keep all rights to the board designs, files, and prompts you provide (“Your Content”). You grant us a limited, worldwide licence to process Your Content solely to operate, secure, and improve the Service — including transmitting it to the model providers needed to produce a result, as described in our Privacy Policy. The Tapeout software, brand, and site are owned by us or our licensors. “KiCad” is a trademark of its respective owners; Tapeout is an independent tool for use with KiCad and is not endorsed by or affiliated with them.
8. Third-party services
The Service depends on third parties, including model providers, Lemon Squeezy (Lemon Squeezy, LLC), identity providers, and hosting. We are not responsible for their acts, availability, or terms, and your use of them may be subject to their own agreements.
9. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted or error-free, or that any output is correct or manufacturable.
10. Limitation of liability
To the maximum extent permitted by law, Tapeout will not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost data, or the cost of fabricated boards or components, arising from or related to your use of the Service. Our total aggregate liability for any claim is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or where required by law. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new “last updated” date. Your continued use of the Service after a change takes effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-law rules. Mandatory consumer-protection rights in your country of residence continue to apply.
